Our fee structure for a "turn-key" residential purchase - off the plans

Our fees are charged in two stages:

Before confirmation: Our fees are charged on a time basis
After confirmation: Our base fee applies

BEFORE THE CONTRACT IS CONFIRMED

Our attendances in assisting you with the purchase will differ depending on each transaction. Before the contract is confirmed, often our attendances will include (but are not limited to):

  • Reviewing the contract and reporting to you;
  • Meeting with you to discuss the contract;
  • Telephone advice;
  • Head title report;
  • Negotiating changes to clauses and time frames within the contract;
  • Extensions of conditions;
  • Reviewing a building contract (if applicable);
  • Confirming or cancelling the contract;
  • Payment of the deposit before confirmed or upon being confirmed;
  • KiwiSaver withdrawal;
  • Ordering/reviewing LIM report.

Our hourly rates are between $280 to $440 plus office services of 5% and GST. We reserve the right to render accounts monthly. Otherwise an invoice will be rendered upon the contract being confirmed or cancelled.

In addition to our fee as above, the disbursements payable (as required) are:

Our fee covers all matters ordinarily included in a purchase. Our base fee is limited to:
  • Reporting on the title once this issues;
  • Receiving bank instructions from one trading bank in New Zealand (ANZ, ASB, Westpac, BNZ, Kiwibank, the Co-Operative Bank) and meeting with you to sign before settlement;
  • Attending to settlement and registration of change of ownership and mortgage.

We appreciate that you wish to have an indication of the legal costs at the outset before we undertake any work on your behalf. Often attendances will arise which we do not anticipate at the outset.

Listed below are additional attendances which are not covered in our base fee and are charged on a time basis (plus office services of 5% and GST):

  • Reviewing a building contract;
  • Council enquiries;
  • Defects in title, advice, requisitioning title;
  • Negotiations including building issues and price reductions;
  • GST/tax issues;
  • Settlement date changes;
  • Refinance or mortgage of another property;
  • Additional security including security from a company;
  • Reverse Equity Mortgage;
  • Manual registration;
  • Company or trust as Purchaser;
  • Issues with pre-settlement inspections, disputes with the Vendor & price reductions/retentions;
  • Delays in settlement;
  • Receiving bank instructions from a non-trading bank.
Listed below are additional attendances which are not covered in our base fee and are on a minimum set fee basis (plus office services of 5% and GST):
